Abstract
The Information Commissioner has published a short Good Practice Note outlining what employers should do in terms of data protection under the TUPE regulations. The note covers what information on employees should be transferred on to the new employer on a transfer of undertakings, whether the TUPE regulations apply or not, what should be disclosed to the employee and what should be retained by the original employer.
